Copyright and DMCA policy

How to tell us that something on KODEx infringes your copyright, how to answer a notice about something you posted, and what happens to accounts that infringe repeatedly.

In effect from 30 October 2026

This page is a draft and must not be published as it stands.

3 values have not been set, and they appear in the text below in square brackets:

  • Designated agent — set NEXT_PUBLIC_LEGAL_DMCA_AGENT
  • Agent postal address — set NEXT_PUBLIC_LEGAL_DMCA_ADDRESS (or NEXT_PUBLIC_LEGAL_ADDRESS)
  • Agent telephone — set NEXT_PUBLIC_LEGAL_DMCA_PHONE

This notice disappears on its own once they are set. It is shown to every reader until then, deliberately.

Our approach

KODEx respects copyright and expects its users to. Most of what it holds is published by the United States government; where material belongs to someone else, it is attributed and linked to the original, as the data sources and attributions page sets out. Users can also store their own notes and sheets, some of which others can see. We respond to notices of claimed infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512).

Our designated agent

Send copyright notices and counter-notices to our designated agent:

[Designated agent’s name not yet set]
Copyright Agent, Kura Notes LLC
[Postal address not yet set]
Email: support@kuranotes.app
Telephone: [Telephone not yet set]

Email is quickest. Write “DMCA notice” or “DMCA counter-notice” in the subject. This address is for copyright matters; for anything else, write to support@kuranotes.app.

Sending a notice of infringement

To be effective under 17 U.S.C. § 512(c)(3), your notice must be in writing and include:

  1. your physical or electronic signature, as the copyright owner or a person authorised to act for them;
  2. identification of the copyrighted work you say is infringed (or, for several works, a representative list);
  3. identification of the material you say is infringing, with enough detail for us to find it — the address (URL) of each page is best;
  4. your name, postal address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law; and
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of the right said to be infringed.

When we receive a notice that meets these requirements, we remove or disable access to the material expeditiously, and tell the user who posted it, with a copy of the notice. A notice that leaves out a required element may not be acted on; we will tell you what is missing if we can.

Sending a counter-notice

If material you posted was removed and you believe that was a mistake or misidentification, you may send a counter-notice under 17 U.S.C. § 512(g)(3). It must be in writing and include:

  1. your physical or electronic signature;
  2. identification of the material that was removed and where it appeared before it was removed;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. your name, postal address and telephone number; and
  5. a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Kura Notes LLC may be found), and that you will accept service of process from the person who sent the original notice, or their agent.

When we receive a valid counter-notice, we send a copy to the person who sent the original notice and tell them we will restore the material in 10 business days. We restore it no sooner than 10 and no later than 14 business days after we received the counter-notice, unless our agent first receives notice that the complainant has filed a court action seeking to restrain you from the infringing activity.

Repeat infringers

We close, in appropriate circumstances, the accounts of users who are repeat infringers. An account that is the subject of more than one valid notice that has not been successfully countered may be suspended or closed, and we may close an account after a single notice where the infringement is clear and deliberate.

Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. If you are not sure whether material infringes your rights, or whether a use is permitted (for example, as fair use), consider asking a lawyer before sending a notice.

Licensed code sets

KODEx does not hold the descriptors of the AMA’s CPT®, the ADA’s CDT® or X12’s CARC and RARC lists. If you believe a page shows licensed wording anyway, tell us at either address above and we will remove it. This page is governed by the terms of service, including the choice of the law of the State of Georgia.
